Home/Privacy Policy
This Policy explains what personal information we collect when you use pixelandcanvas.net, why we collect it, who we share it with, and the choices you have. It works alongside our Terms of Service.
This Privacy Policy is issued by MM ECO LLC, a Washington limited liability company doing business as Pixel & Canvas (“Pixel & Canvas,” “we,” “us,” or “our”). It governs our handling of personal information collected through pixelandcanvas.net (the “Site”), our products and services (the “Services”), and any painting you commission from us.
For any privacy-related question or request, email us at [email protected] with the subject line “Privacy Request.”
When you interact with the Services, you may give us:
When you visit the Site, we and our service providers automatically collect:
We receive limited information from third parties helping us run the business:
The photographs you upload or send us are the most sensitive information we receive. The license terms (what we may do with them to fulfill your Order) are set out in Section 5 of our Terms of Service. This section covers the privacy specifics.
We use the information described above for the following purposes:
We and our service providers use cookies, pixels, local storage, and similar technologies. In plain language, they fall into four categories:
You can block or delete cookies in your browser settings. Doing so for the “strictly necessary” category may prevent checkout from working. See Section 9 for how to opt out of “sale” and “sharing” of personal information for cross-context advertising under California and other state laws.
We use the following service providers. We share with each only the information they need to perform the function listed.
| Provider | What we use it for |
|---|---|
| WordPress & WooCommerce | Website platform and storefront. |
| Our hosting provider | Server infrastructure, file storage (including Source Material), backups. |
| Stripe | Credit/debit card, Apple Pay, and Google Pay processing. |
| PayPal | PayPal payment processing. |
| Mailchimp | Marketing email and transactional notifications (order confirmations, shipping updates). |
| Google Analytics 4 | Aggregated traffic analytics: pages visited, sources of traffic, on-site behavior. |
| Microsoft Clarity & Hotjar | Session-replay analytics. Mouse movement, scrolls, and clicks are recorded; personal-information fields are masked by default. |
| Meta (Facebook) Pixel | Advertising on Facebook and Instagram, conversion tracking, retargeting. |
| Google Ads conversion tracking | Measuring the effectiveness of our Google Ads campaigns. |
| ChatBuster | Live chat / customer-support widget on the Site. |
| UPS, FedEx, USPS | Shipping carriers. We share recipient name, shipping address, and email for delivery notifications. |
Each provider has its own privacy policy. If you want to review them, search for the provider name plus “privacy policy” or visit their website.
We disclose personal information only to the following categories of recipients:
We do not sell your personal information for money. However, under California and certain other state privacy laws, the term “sale” or “sharing” is defined broadly enough that our use of advertising-and-targeting cookies (for example, the Meta Pixel and Google Ads conversion tracking listed in Section 6) may qualify as “sharing” for cross-context behavioral advertising. You can opt out as described in Section 9.
We keep personal information only for as long as we need it for the purposes set out in this Policy, plus a reasonable period to handle disputes, defend claims, and comply with our legal obligations. Typical retention periods:
Depending on where you live, you may have some or all of the following rights:
If you are a California resident, the rights above are guaranteed under the California Consumer Privacy Act, as amended by the California Privacy Rights Act.
Categories of personal information we have collected in the past 12 months (mapped to the CCPA categories): Identifiers (name, email, IP); Customer records (contact and billing details); Commercial information (orders); Internet or other electronic network activity (interaction with the Site); Geolocation (approximate, derived from IP); Visual information (photographs you upload as Source Material); Inferences (drawn from analytics for marketing measurement).
Sources: directly from you; automatically from your interaction with the Site; and from the service providers listed in Section 6.
Purposes: as described in Section 4.
Categories of recipients: as described in Sections 6 and 7.
Sensitive personal information: we do not collect sensitive personal information for purposes of inferring characteristics about you. Payment-card information is technically sensitive while in transit, but it is processed directly by our payment processors and is not stored on our systems.
“Shine the Light” (California Civil Code §1798.83): we do not share personal information with third parties for those third parties’ direct-marketing purposes.
If you are a resident of a US state whose law grants you privacy rights similar to those described in Section 9.1, you may exercise them by following the process in Section 9.4. Specific rights vary by state law (for example, Colorado and Connecticut grant a formal right to appeal a denial; see Section 9.5).
Email us at [email protected] with the subject line “Privacy Request” and tell us:
We respond within 45 days. If we need more time (up to an additional 45 days), we will tell you why.
If we deny your request in whole or in part and your state’s law gives you a right of appeal (Virginia, Colorado, Connecticut, and certain other states), you may appeal in writing to [email protected] with the subject line “Privacy Appeal.” We will respond within 60 days. If you remain dissatisfied, you may submit a complaint to your state’s Attorney General.
You may authorize another person to submit a request on your behalf. We will require written authorization signed by you, and we may need to verify your identity directly.
If your browser sends a Global Privacy Control signal, we treat that as a valid opt-out of “sale” and “sharing” of your personal information for cross-context behavioral advertising under California and other state laws that recognize GPC. You do not need to take any further action.
The Services are intended for adults. Under our Terms of Service, users must be 18 or older. We do not knowingly collect personal information from children under 13, and we do not direct the Services at children. If you believe a child under 13 has provided personal information to us, please email [email protected] and we will delete it.
We use reasonable administrative, technical, and physical safeguards to protect personal information, including HTTPS encryption in transit, access controls and a need-to-know basis for employees and service providers, and PCI-compliant payment processors that handle card data directly.
No method of transmission over the internet or method of electronic storage is 100% secure. We cannot guarantee absolute security. You provide your personal information to us at your own risk.
Most web browsers offer a “Do Not Track” (DNT) setting. Because the industry has not settled on a uniform standard for how to respond to DNT, we do not currently respond to DNT signals.
We do respect Global Privacy Control (GPC) signals as a valid opt-out under Section 9.7.
The Site and Services are operated from the United States and we ship within the US only. If you access the Site from outside the United States, you are transferring your personal information to the United States, where our servers and offices are located, and you consent to that transfer. This Policy is written under US law and does not provide rights under the GDPR, UK GDPR, LGPD, or other non-US privacy regimes.
We may update this Policy from time to time. The “Last updated” date at the top reflects the current version. For material changes, we will post a more prominent notice on the Site (and, where appropriate, send an email to subscribers). Your continued use of the Services after an update means you accept the revised Policy.
